LOGIN CHPORT FOR PARTNERS * Art. 2 exp. 3 of the Swiss Federal law employment agency and the personnel rental business (AVG) subordinates the switching from the foreign country of a grant obligation. After art. 3 exp. 1 AVG is a condition for the grant distribution the entry of the mediator in the Swiss Register of Companies. Such an entry is refused for foreign mediators without an office in Switzerland. Direct switchings into Switzerland by foreign mediators are therefore forbidden. Active mediators outside of Switzerland can offer their services also over the Internet. The mediator is making an offence against the prohibition if they have the intention of mediating transnational. In accordance with art. 39 exp. 2 lit. a AVG the enterprise and the foreign employment agency will punish themselves if they act against the prohibition of the foreign switching. |
